Arbitration
Before initiating arbitration, a party must provide the other party with written notice describing the dispute and the relief requested and allow at least 30 days for the parties to attempt to resolve the matter informally. Except for claims that qualify for small claims court or requests for temporary or preliminary injunctive relief, any unresolved dispute arising out of or relating to these Terms or the Site shall be resolved by final and binding arbitration under the Federal Arbitration Act before a single neutral arbitrator administered by the American Arbitration Association under its applicable consumer rules. The arbitration may be conducted remotely or at another reasonably convenient location agreed by the parties. The arbitrator may award any relief available to an individual claimant under applicable law. Each party will bear its own attorney’s fees and costs except where applicable law or the arbitration rules permit an award of fees or costs. A court of competent jurisdiction, rather than the arbitrator, will decide any dispute concerning the formation, validity, or enforceability of this arbitration provision. Judgment on the award may be entered in any court having jurisdiction. This provision survives termination of these Terms.
Class Action Waiver
Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Arizona’s Children Association agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.
